The example below shows the costs the authorities may recover from the carrier in a situation which involves an inadmissible person, who has been refused entry to serve a prison sentence and subsequently applies for a residence permit. A replacement travel document (laissez passer) is applied for on several occasions and the inadmissible person is eventually removed, escorted by the Royal Netherlands Marechaussee. Prior to removal, a medical examination has been conducted at the request of the foreign national. The total costs to be recovered from the carrier turn out to be € 11,550.
The rates have been laid down in law, in the List of rates (Annex 22 to the Aliens Regulations 2000). The rates used in this sample are from January 2014, since then the prices have gone up.
The number of escorts required is calculated based on the Matrix for use of escorts of the Royal Netherlands Marechaussee.
In case of variable costs, such as the costs of a laissez-passer, the bills of the actually incurred costs will be attached to the invoice.

The Royal Netherlands Marechaussee refuses Mr A. Lien entry into the Netherlands because he has tried to enter the country with counterfeit travel documents. He has a boarding pass which proves that he arrived on flight AB456 from country Y.

The Royal Netherlands Marechaussee faxes a removal order for passenger A. Lien to the carrier, in which the option has been checked that the inadmissible person may not be removed immediately. A. Lien first has to serve his prison sentence for the crime he has committed. No costs of stay are charged to the carrier for the time the inadmissible person is detained.

The court rules that Mr A. Lien is remanded until 15-05-2016.

In a booking request the Royal Netherlands Marechaussee requests the carrier to put the duty to return, as stated in the removal order, into effect. The Marechaussee indicates that the desired date of return is the end date of detention, namely 15-05-2016.
In the booking request, the Marechaussee also states to draw up a covering letter for the inadmissible person.
The Marechaussee also states in the booking request that they advise in favour of assisted removal of the person involved - after having done a risk analysis. The Marechaussee states that it needs three escorts for the assisted return, who will be available as of 15-05-2016.

In a letter, the carrier communicates that the transportation of the inadmissible person to the place of destination is not possible with a covering letter. The carrier requests the Marechaussee to apply for a (replacement) travel document for the inadmissible person. The Marechaussee forwards this request to the Repatriation and Departure Service.

In order to be able to apply for a laissez passer, it has to be clear what the inadmissible person's nationality is. Therefore, the Repatriation and Departure Service orders a language analysis to be conducted. The results are inconclusive. Costs of the language analysis are € 500.

The Repatriation and Departure Service starts the application procedure for a laissez passer with the presumable country of origin of the foreign national with the aim of establishing his identity/nationality and of obtaining a replacement travel document. The services of an interpreter have been used in the application for a laissez passer. The application for a replacement travel document by the Repatriation and Departure Service costs € 597. The interpreter costs are € 55.

The inadmissible person has been presented (in person) to the diplomatic representative of his presumed country of origin. The diplomatic representative is located in The Hague. The transportation costs of the personal presentation (Amsterdam - The Hague) are € 299.60.

The Marechaussee states that it needs three escorts for the assisted return, who will be available as of 15-05-2013, the end date of detention.
The extra remark in the subsequent booking request indicates that in view of his medical condition, the inadmissible person involved must undergo a medical examination prior to removal, in order to confirm that he is fit to fly.

Upon his release from detention the inadmissible person immediately applies for residence in the Netherlands. The Marechaussee sends the carrier a flight cancellation request. During the period in which this application is assessed, no costs of stay are charged to the carrier.
16-06-2016
The application for residence of the inadmissible person involved is denied. The Marechaussee sends the carrier a subsequent booking request. In this request, it is stated again that a (replacement) travel document is available and that in view of his medical condition the inadmissible person involved must be medically examined in order to be declared fit to fly. The desired removal date is 19-06-2013.
The Marechaussee also states in the booking request that they advise in favour of assisted removal of the person involved - after having done a risk analysis. The Marechaussee states that it needs three escorts for the assisted return, who will be available as of 19-06-2013.

Mr A. Lien is medically examined and declared fit to fly. The medical examination costs € 500.

The inadmissible person starts trouble on the day of his removal. The pilot refuses to transport the inadmissible person.
The inadmissible person has not left the country. The Marechaussee sends the carrier a flight cancellation request and immediately sends a subsequent booking request, in which the details stated above are repeated. The desired removal date is now 25-06-2013. Escorts will be available as of that date.
The inadmissible person remains at the border lodgings awaiting his departure from the Netherlands. Since the inadmissible person is not transported within 48 hours after the date stated in the subsequent booking request (i.e. 19-06-2013), any costs incurred until the inadmissible person's departure may be recovered from the carrier.

Intention date: The DT&V sends an intention, before sending the invoice. The intention consists of a summary of costs, relevant documents to substantiate the costs and an outline of the case the invoice will be send for. The carrier is given 4 weeks to react to the intention.
Invoice date: The DT&V sends an invoice to the carrier for the costs incurred. The administration costs for handling the invoice are € 500.
